Application for permanent residence status in China for foreign spouses of Chinese or foreign nationals

According to Regulations of the Peopleโ€™s Republic of China on Administration of the Entry and Exit of Foreigners, Rules Governing the Implementation of the Law of the PRC on the Entry and Exit of Foreigners and Regulations on Examination and Approval of Permanent Residence of Foreigners in China,

Eligibility:

The applicant should be the spouse of a Chinese citizen or of a foreign national who has permanent residence status in China.

The applicant and his or her spouse should be married for a minimum of five years. The applicant should be a resident of China for a minimum of five consecutive years – and a minimum of nine months each year.

The applicant should have a fixed and legal residence and a stable source of income.

Documents required:

  1. Valid foreign passport or alternate approved travel document.
  2. Health certificate issued by a medical institution designated by the Chinese government or issued by foreign medical institutions certified by a Chinese embassy or consulate.
  3. Document offering proof the applicant does not have a criminal record, issued by a Chinese embassy or consulate.
  4. Four 2-inch photos.
  5. A certificate of long-term household registration of the Chinese spouse or the Permanent Residence Permit of the foreign spouse, marriage certificate, notarized certificates of living guarantees, certificate of house ownership or lease, certificates or other documents issued by foreign organizations must be certified by the Chinese embassy or consulate in the country of issuance.

Procedure:

Submission of completed application form for permanent residence in China.

Fees:

Application fee: 1500 yuan ($234.8) per person

Certification fee: 300 yuan per certificate

Processing times:

The public security organ decides to approve or not to approve the application within six months from the day the foreign applicant submits the application for a permanent residence permit.

Responsible departments:

Applications for permanent residence in China relating to foreign nationals are received by the public security organ at the city level, checked by the municipal public security organs, reviewed by public security departments at the provincial level or by the authorities of autonomous regions and municipalities – and examined and approved by the Ministry of Public Security.

Eligibility:

Minors dependent on their parents

Documents required:

  1. Valid passport or alternate approved travel document
  2. Health certificate issued by a medical institution designated by the Chinese government or issued by foreign medical institutions certified by a Chinese embassy or consulate
  3. Document offering proof the applicant does not have a criminal record, issued by a Chinese embassy or consulate
  4. Four 2-inch photos
  5. A certificate of household registration if the parents are Chinese citizens or if the parents are foreign nationals holding Permanent Residence Permits;

Birth certificates or kindred certificates;

Certificates of adoption in case of adoptive relationships

Certificates or other documents issued by foreign organizations must be certified by the Chinese embassy or consulate in the country of issuance

Fees:

Application fee: 1500 yuan ($234.8) per person

Certification fee: 300 yuan per certificate

Residence Permit (for one year)

โ… . Qualifications:

A foreigner can apply for the residence permit for one year under any of the following circumstances:

1. Holding office or being employed in Shanghai;

2. Resident Correspondent in Shanghai;

3. Engaged in commercialized theatrical performance in Shanghai.

The accompanying spouse, children under the age of 18 and parents of such personnel can apply at the same time for the Foreignerโ€™s Residence Permit for the same period as such personnel.

โ…ก. Formalities:

1. Submitting the Foreigner Visa and Residence Permit Application Form completely filled up and one recent 2-inch half-length, bareheaded and full-faced photograph;

2. The original of the certificate of check-in in Shanghai (issued by the hotel or the police substation of the area where the lodging takes place);

3. Handing over the originals of the valid passport and visa for examination;

4. Submitting the original of the Health Certificate issued by Shanghai health quarantine department (15, Jinbang Road, Changning District);

5. Submitting the official letter of application of the unit;

6. Submitting the original and the copy of the Certificate of Approval of Enterprise, the Duplicate of Business License or the Representative Agency Registration Certificate and the organization code;

7. Persons from the general manager down (or F-type persons holding the Shanghai Residence Card B) should submit the originals of the Employment Credential and the Employment Registration Form; the vice president should submit the original of the Identity Confirmation Certificate issued by Shanghai Foreign Economic Relations and Trade Commission; the foreign expert should submit the original of the Expert Certificate; the resident correspondent should submit the original of the Press Card; the person engaged in commercialized theatrical performance needs to submit the originals of the official document approving the performance by the Ministry of Culture or Shanghai Cultural Bureau and the Performance Credential issued by Shanghai Cultural Bureau; the person engaged in offshore petroleum operations should submit the Work Permit for Foreign Personnel Engaged in the Offshore Petroleum Operations.

The accompanying family members of such kinds of personnel should provide the copy of the Family Relation Certificate and corresponding documents, besides their own valid passports and visas.

An applicant under the age of 18 or above the age of 70 or an applicant, who extends the Residence Permit within 3 months as of its expiration, can be exempted from submitting the Health Certificate.

The applicant under the age 18 or above the age of 70 should go through the formalities in person for the first application.
